Rocky Mountain Gun Owners (RMGO), a group of far-right gun owners decided to sue the town of Colorado and filed a complaint to block bans on assault weapons and to protect their right to carry firearms in public in federal court on Thursday, July 7, 2022.
Colorado passed a law in 2021 after a deadly shooting at a supermarket in Boulder, CO, to give more power to local governments for gun regulation. The town Superior used this law to hold a vote to ban all assault weapons in June of 2022 through a city ordinance. The ordinance passed and went into effect on July 1, 2022. RMGO claims that it conflicts with their Second Amended rights to bear arms in public.
In the complaint, RMGO alleges that “millions of law-abiding citizens own and use” assault weapons that the ordinance specifically bans, using “politically charged rhetoric to describe the arms it bans”, such as “large capacity.” The ordinance which was passed in June stated that any ammunition magazine with more than ten rounds was deemed as having a “large capacity.”
RMGO also quotes the recent Bruen case, which was a recent win for gun rights advocates around the country. The Bruen case challenged New York’s concealed carry law. The Supreme Court ruled that the part of the law that requires applicants to show “proper cause” in order to carry a handgun in public is unconstitutional.
The group is asking the judge in the case to overturn the ordinance
